1. Agreement to Terms

By using the NeuroHaven App, you agree to these Terms of Service ("Terms"). If you do not agree, please discontinue use immediately. These Terms constitute a binding agreement between you and Software People Love.

2. About the App

NeuroHaven is an ADHD-friendly daily mood journal and planner designed to help users track emotions, identify patterns, and build healthy habits through creative self-expression. The App uses emojis, GIFs, sounds, and customizable templates to make mood tracking engaging and accessible.The App is designed for personal self-reflection and organization. It does not provide medical, psychiatric, or therapeutic services. NeuroHaven is not a substitute for professional mental health care.

3. Mental Health Disclaimer

NeuroHaven provides tools for mood tracking and self-reflection only. The App does not diagnose, treat, cure, or prevent any mental health condition, including ADHD. Pattern recognition and insights are for informational purposes only.If you are experiencing mental health difficulties, suicidal thoughts, or emotional distress, please seek help from qualified mental health professionals immediately. In emergencies, contact your local emergency services or crisis hotline.The App's reminders, achievements, and gamification features are motivational tools only and should not replace professional ADHD management strategies or medical treatment.

4. User Content and Conduct

You retain ownership of all content you create in NeuroHaven (mood entries, journal notes, voice memos, photos). By using the App, you grant us a limited license to process and store your content solely to provide the service.Users must not:
• Use the App to impersonate healthcare professionals
• Share content that violates others' privacy
• Attempt to extract or scrape other users' data
• Use the App for any illegal or harmful purposes
• Circumvent security measures

5. Intellectual Property

All App content, features, and functionality (excluding user content) are owned by Software People Love and protected by intellectual property laws. The NeuroHaven name, logo, and all related designs are our trademarks.You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

6. Third-Party Services

NeuroHaven integrates with third-party services including GIF providers (Giphy/Tenor) and cloud storage services. Your use of these features is subject to those services' terms and privacy policies. We are not responsible for third-party content or services.

7. Limitation of Liability

The App is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Software People Love and Playpen Games, Inc. disclaim all liability for:• Any mental health outcomes or emotional distress
• Loss of data or journal entries
• Interruptions or errors in service
• Reliance on mood insights or pattern recognition
• Indirect, incidental, or consequential damagesOur total liability is limited to the amount you paid us in the 12 months preceding any claim.

8. Indemnification

You agree to indemnify and hold harmless Software People Love, Playpen Games, Inc., and their affiliates from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

9. Privacy and Data Protection

Your use of NeuroHaven is subject to our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our data practices as outlined in the Privacy Policy.

10. Modifications and Termination

We may modify these Terms at any time. Significant changes will be notified through the App. Continued use after changes constitutes acceptance. We reserve the right to suspend or terminate accounts that violate these Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under the American Arbitration Association rules in Delaware. You waive any right to class action proceedings.

We are committed to making NeuroHaven accessible to users with diverse needs, including those with ADHD and other neurodivergent conditions. If you encounter accessibility issues, please contact us so we can improve the experience.
